In a recent ruling, Morocco’s Constitutional Court declared that the Organic Law No. 30.24, which amends and supplements Organic Law No. 02.12 concerning appointments to high office, is compliant with the Moroccan Constitution. This decision effectively upholds the legality of the new law, paving the way for its continued implementation.
The court’s decision comes after receiving a request for review from the Prime Minister on August 2, 2024. The Prime Minister sought to ensure the law’s alignment with the principles and articles enshrined in the Moroccan Constitution, specifically Articles 49 and 92, which outline the roles of the parliament and the executive branch in the legislative process.
After a thorough examination of the case files and the legislative process, the Constitutional Court confirmed that Organic Law No. 30.24 had been meticulously reviewed and approved according to the constitutionally mandated procedures.
The court highlighted the following steps in the law’s journey:
Initial deliberation: The draft law was first discussed by the Council of Ministers on June 1, 2024, in accordance with Article 49 of the Constitution.
Submission to Parliament: The draft law was then submitted to the House of Representatives on June 13, 2024.
Parliamentary Review and Approval: Following a mandatory 10-day waiting period, the House of Representatives reviewed and unanimously approved the draft law on July 8, 2024.
Final Approval: The House of Advisors, Morocco’s upper house of parliament, also unanimously approved the law on July 23, 2024.
